Mighty Junk Removal LLC – Terms of Use

Roll-Off Junk Removal Rental Terms and Conditions

This transaction, including Mighty Junk Removal LLC’s rental of Equipment to Customer, is expressly limited to and conditioned upon Customer’s acceptance of these terms and any related Rental Documents, including quotations, proposals, acknowledgments, and/or invoices. These terms govern all Rental Documents, forming the entire agreement between Mighty Junk Removal LLC and Customer. Any additional or differing terms provided by Customer are specifically rejected and excluded.

Acceptance and Contract Formation

This transaction, including Mighty Junk Removal's rental of Equipment to Customer, is expressly limited to and conditioned upon Customer’s acceptance of these terms and any related Rental Documents, including quotations, proposals, acknowledgments, and/or invoices. These terms govern all Rental Documents, forming the entire agreement between Mighty Junk Removal and Customer. Any additional or differing terms provided by Customer are specifically rejected and excluded.

Order Processing

All rental orders must be placed through Mighty Junk Removal LLC’s order page. An order is considered binding once the Customer completes the checkout process and signs the rental agreement provided during that process. The Customer is responsible for scheduling Equipment delivery and pick-up in accordance with the terms outlined in the agreement.

Delivery and Pick-Up

Mighty Junk Removal LLC will make every effort to deliver and retrieve Equipment in a timely manner. However, Mighty Junk Removal LLC is not liable for costs or damages arising from delays due to external factors such as weather, road conditions, or equipment issues.

Customer agrees not to move the Equipment from the designated site without written consent. A $125 inconvenience fee may apply if Mighty Junk Removal LLC cannot access the Equipment due to blocked access or other obstructions (a “dry run”), and this fee may be charged to the Customer’s payment method.

Prices and Payment Terms

Rental prices are clearly listed on the Mighty Junk Removal LLC website and in the online order form. Charges are billed per rental term. Customer authorizes Mighty Junk Removal LLC to retain and charge the payment method provided for rental fees, Overload Fees, and any other applicable charges, valid for up to 120 days beyond the rental term. If authorization is revoked, Mighty Junk Removal LLC may immediately terminate the rental agreement without notice and recover the Equipment.

Cancellation and Fees

Orders cannot be canceled without Mighty Junk Removal LLC’s approval. Approved cancellations will incur a $125 fee if canceled after noon on the prior business day. Consider purchasing cancellation insurance or opting for our premium service, which includes cancellation coverage if you are unsure about your situation.

Weight Restrictions and Overload Fees

Customer is responsible for complying with Equipment weight limits. Overloads incur an additional fee of $0.10 per pound over the limit for standard service and $0.05 per pound for premium service, charged to the Customer’s payment method or immediately invoiced.

Prohibited Substances

Hazardous materials—such as tires, batteries, and paints—are prohibited in the Equipment. Customer is liable for any damages or charges arising from prohibited substances. If the Customer attempts to hide such materials, they are liable for 200% of dump fines incurred by Mighty Junk Removal LLC as a result.

Permits

Customer is solely responsible for obtaining any necessary permits required for Equipment placement and usage. Failure to comply may result in additional fees or penalties, which will be billed to the Customer.

Indemnification

Customer agrees to indemnify and hold harmless Mighty Junk Removal LLC for any claims, losses, or damages resulting from misuse of the Equipment, failure to obtain permits, or any breach of these terms.

Waiver, Limitation of Liability, and Disclaimer of Warranties

CUSTOMER WAIVES ALL CLAIMS AGAINST MIGHTY JUNK REMOVAL LLC FOR DAMAGES RELATING TO THE EQUIPMENT RENTAL, INCLUDING DAMAGE TO PROPERTY OR UNDERGROUND UTILITIES. EQUIPMENT IS PROVIDED “AS-IS” WITHOUT WARRANTIES OF ANY KIND.

Governing Law

All disputes shall be governed by the laws of the State of New Mexico.

Reservation of Rights

Mighty Junk Removal LLC reserves all legal and equitable rights.

Entire Agreement

These terms and the associated Rental Documents constitute the entire agreement between the parties. No modifications are valid unless approved in writing by Mighty Junk Removal LLC.
